    LEGAL NOTICE NOTICE OF ANNUAL SCHOOL DISTRICT ELECTION AND BUDGET

    LEGAL NOTICE

    NOTICE OF

    ANNUAL SCHOOL

    DISTRICT

    ELECTION

    AND BUDGET HEARING

    NOTICE IS HEREBY GIVEN that a public hearing for the qualified voters of the Cuba-Rushford Central School District (the “District”) on the proposed 2025-2026 budget will be held in the Elementary School Library, Cuba, New York, on Tuesday, May 13, 2025 beginning at 6 p.m.

    NOTICE IS ALSO GIVEN that the Annual School District Meeting and Vote of the District (the “Annual Vote”) will be held on May 20, 2025 from 12:00 P.M. (noon) to 8:00 P.M., prevailing time, at the following schoolhouse and Town Hall in which school and business is maintained during the hours designated:

    Cuba-Rushford School District

    Elementary School Building

    Room 105

    15 Elm Street

    Cuba, New York 14727

    Rushford Town Hall Building

    8999 Main Street

    Rushford, New York 14777

    for the purposes of voting upon the election of two (2) members of the Board, voting on the appropriation of necessary funds to meet the established expenditures of the District for the 2025-2026 fiscal year, voting on certain propositions involving expenditure of money and, as applicable, authorizing the levy of taxes by the District, and transacting such other business as may be authorized by law or rules of the Board.

    NOTICE IS ALSO GIVEN that a copy of the statement of the amount of money which will be required for the ensuing year for school purposes exclusive of public money, will be available upon request to residents within the District from May 6, 2025 through May 20, 2025 except Saturday, Sunday, or Holidays, at the following schoolhouse and town hall building in which school and business is maintained during the hours designated:

    Middle-High School Building

    District Office

    5476 Route 305

    Cuba, New York 14727

    between the hours of 9 a.m. and 3 p.m. Monday –

    Friday; and

    Rushford Town Hall Building

    8999 Main Street

    Rushford, New York 14777

    between the hours of 9 a.m. and 12 NOON and 1 p.m. and 4 p.m., Monday, Tuesday, Thursday, Friday.

    NOTICE IS ALSO GIVEN that an election for members of the Board shall be held to fill two (2) vacancies on the Board created by the expiration, on June 30, 2025, of the terms of Aileen Sirianni and Joseph Wright. The candidate receiving the highest vote total for each specific seat will be elected to five (5) year terms commencing July 1, 2025 and ending on June 30, 2030.

    NOTICE IS ALSO GIVEN that all candidates for the office of member of the Board shall be nominated by petition. Petitions must be filed with the Clerk of the District between 9:00 a.m. and 3:00 p.m. not later than the 30th day preceding the Annual Vote, to-wit, by 5:00 p.m. on April 21, 2025. Each Petition must be directed to the Clerk of the District, must be signed by at least twenty-five (25) qualified voters of the District, or by two percent of voters who voted in the preceding Annual Vote, whichever is greater, must state the residence of each signer, and state the name and residence of the candidate.

    NOTICE IS ALSO GIVEN that said Annual Vote will be conducted by the use of paper ballots which will be processed using optical scan voting technology; that the Board has adopted rules and regulations relative to the submission of questions or propositions by the electors of the District to be placed on the said ballots, subject to the Education Law of the State of New York; copies of such rules and regulations may be obtained upon request from the Clerk of the District.

    NOTICE IS ALSO GIVEN that personal registration (for those not already registered to vote with the County of Allegany) will be required in order to vote at the Annual Vote. The members of the Board of Registration shall meet to prepare the register of the District for each election district on the following dates, times, and location:

    May 6 -15, 2025 between the hours of 9 a.m. and 3 p.m. (weekdays) at the Cuba-Rushford Middle-High School Building District Office, 5476 Route 305, Cuba, New York.

    Any person shall be entitled to have his or her name placed upon such register, provided that at any such meeting of the members of the Board of Registration he or she is known or proven to the satisfaction of such members to be then or thereafter entitled to vote at the election for which such register is prepared. The register of the District for the Annual Vote shall be filed in the office of the Clerk of the District and such register shall be open for inspection by any qualified voter of the District on each of the five (5) days prior to and the day set for the Annual Vote, except Saturdays and Sundays as follows: Please call the District Clerk to arrange an

    NOTICE IS ALSO GIVEN that voting at the Annual Vote shall consist of electing two (2) members of the Board and voting on the following propositions as well as such other propositions as may be authorized by law and the rules of the Board:

    PROPOSITION NO. 1

    2025-2026 BUDGET

    Shall the following resolution be

    adopted?

    RESOLVED, that the budget of the Cuba-Rushford Central School District (the “District”) for the fiscal year commencing July 1, 2025 and ending June 30, 2026, as presented by the Board of Education in the total amount of $27,089,240, is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the District to be levied and collected as required by law.

    PROPOSITION NO. 2

    PURCHASE OF TWO (2) SCHOOL BUSES

    FOR THE

    TRANSPORTATION

    PROGRAM OF THE DISTRICT

    Shall the following resolution be

    adopted?

    RESOLVED, that the Board of Education of the Cuba-Rushford Central School District, Allegany County, New York (the “District”) be, and it hereby is, authorized to purchase two (2) school buses at a maximum

    estimated cost of $377,776 for use in the transportation program of the

    district.

    PROPOSITION NO. 3

    CUBA

    CIRCULATING

    LIBRARY

    Shall the following resolution be

    adopted?

    RESOLVED, that the Board of Education of the Cuba-Rushford Central School District is hereby authorized to levy and collect taxes annually, separate and apart from the school district budget, in the amount of $295,145 for the Cuba Circulating Library to provide public library services and deliver such funds to the library’s Board of Trustees.

    PROPOSITION NO. 4

    RUSHFORD FREE LIBRARY

    Shall the following resolution be

    adopted?

    RESOLVED, that the Board of Education of the Cuba-Rushford Central School District is hereby authorized to levy and collect taxes annually, separate and apart from the school district budget, in the amount of $86,246 for the Rushford Free Library to provide public library services and deliver such funds to the library’s Board of Trustees.

    NOTICE IS ALSO GIVEN that applications for absentee and early mail ballots may be obtained at the office of the District Clerk between the hours of 9:00 A.M. and 3:00 P.M., prevailing time. Completed applications must be received by the District Clerk at leave seven (7) days before the Annual Vote (May 13, 2025) if the ballot is to be mailed to the voter, or on the day before the Annual Vote (May 19, 2025) if the ballot is to be delivered personally to the voter. A list of all persons to whom absentee and early mail ballots have been issued will be available for inspection by qualified voters of the District in the office of the District Clerk between the hours of 9:00 A.M. and 3:00 P.M., prevailing time, on each of the five (5) days prior to the Annual Vote (except for Saturdays, Sundays, and holidays), and such list will be posted at the polling place. No absentee or early mail ballot will be canvassed and counted unless it is received in the office of the District Clerk prior to 5:00 P.M., prevailing time, on May 20, 2025.

    NOTICE IS ALSO GIVEN that military voters who are not currently registered may apply to register as a qualified voter of the District by requesting and returning a military voter registration application to the District Clerk. Completed military voter registration application forms must be received in the Office of the District Clerk no later than 5:00 p.m. on May 5, 2025. A military voter may indicate his or her preference for receiving the registration application by mail, facsimile transmission, or electronic mail.

    NOTICE IS ALSO GIVEN that military voters who are qualified voters of the District may apply for a military ballot by requesting an application from the District Clerk. For a military voter to be issued a military ballot, the District Clerk must have received a valid ballot application no later than 5:00 P.M. on April 25, 2025. In a request for a military ballot application or ballot, the military voter may indicate their preference for receiving the application or ballot by mail, facsimile transmission, or electronic mail.
