In pursuance of a Judgment of
Foreclosure and Sale, duly made and entered in the above entitled
action and dated November 21, 2025, I, the undersigned Referee, duly appointed in this action for such purpose, will expose for sale and sell at Public Auction to the highest bidder in the First Floor Vestibule of the Allegany County Court House, 7 Court Street in the
Village of
Belmont, Allegany County, New York, on the 28 th day of April, 2026, at 9:00 0'clock in the forenoon of that date, the mortgaged premises directed in and by that judgment to be sold and in that judgment described as follows:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Town of Burns, Village of
Canaseraga, Allegany County, New York, bounded and described as follows: BEGINNING at a point on the centerline of Main Street (a.k.a. New York State Route No. 70), which said point is easterly 440.00 feet from the centerline
intersection of the centerline of Church Street and Main Street; thence south
79°58'39" east along said centerline of Main Street a distance of 77.00 feet to a point; thence south
1°01 '2 1 " west, along the westerly boundary of lands now or formerly of Sugarcreek Stores, Inc. (Liber 958/Page 236), through a 5/8"
rebar, a total distance of 225.49 feet to a S. J. Hubertus, L.S. 5/8" capped
rebar on the northerly boundary of lands of Consolidated Railway; thence south 85° 17'00" west along said northerly boundary of Consolidated Railway a distance of 79.62 feet to a 1/2" rebar with cap; thence north 10°01 '2 1 " east along the easterly boundary of lands now or formerly of Darrell and Sandra L. VanSkiver (Liber 891/Page 246), through a 5/8"
rebar, a total distance of 245.75 feet to the point and place of beginning.
Intending to convey an area of 0.417 acre of land as is more fully shown on a survey map prepared by
James Ball, L.S., under Job No. 2623, entitled "Plan of a Survey Prepared on Lands known as No. 32
Main Street, Village of Canaseraga".
SUBJECT TO all rights of way and easements of
record and SUBJECT TO the rights of the public in and to the traveled portion of any roadways mentioned herein.
BEING THE SAME PREMISES conveyed by World Mission Fellowship, Inc. to Paul R. Sherman and
Randi S. Sherman by Warranty Deed dated May 1 8, 2009 and recorded May 22, 2009 in the Allegany County Clerk's Office,
Instrument No. 2009-37492.
Judgment Amount – $31,256.89 plus interest, costs and expenses.
Sale is subject to all outstanding taxes.
