On or about May 24, 2026
Cattaraugus County will submit a
request to the US
Department of Housing and Urban
Development (HUD) for the release of Lead Hazard Control Grant Program funds,
authorized by Sec. 1011 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Title X of the Housing and
Community
Development Act of 1992), Public Health Law 102-550. Funding was approved and provided by the Consolidated Appropriations Act of 2018, approved March 23, 2018 (Public Law 115-141) for the following multi-year program/project. The Cattaraugus-Allegany County Lead Hazard Reduction Grant Program will undertake the following project activities: This is a 48 month project to
reduce lead based paint hazards in Cattaraugus County and Allegany County through residential rehabilitation. Both counties will be performing lead-based paint
inspection and lead hazard risk
assessment in housing units, which include
eligible privately owned rental or owner-occupied housing. Units will be individual
properties throughout
Cattaraugus County and Allegany County which are eligible for HUD funding as determined by the Tier II environmental review and other program requirements. Each eligible unit may undergo the control and
elimination of all lead-based paint hazards through
interim controls or lead-based paint abatement. Rehabilitation at each unit will be primarily inside the home but may include outdoor RRP activities either by scraping and painting or
encapsulation with siding. Some minor ground disturbance within 4 feet of the foundation may be necessary for a home found to have lead contamination in the soil. In some cases the soil may be encapsulated through turf establishment, mulch or hardscape. Most project work is
considered "minor rehabilitation" in that the proposed
activities will
not increase unit density beyond four units; the land use is not changing; and the footprint of the building (i.e., foundation, decks, garages, porches, etc.) is not being extended into a floodplain or wetland. However, due to the possibility of soil contamination found at project sites and the need for ground
disturbance in those cases, projects in wetlands will not be considered eligible for grant funding and projects in flood plains will
require flood insurance policies. Specific policies have been established for projects to
mitigate the environmental risks per federal and state laws.. The expected average cost per unit will be $45,000 for intervention work paid for with leveraged funds. Any project that exceeds $75,000 will be evaluated between both counties and pre-approval will be obtained from the HUD Grant Technical Representative. Cattaraugus County is requesting the release of $4,000,000 of Lead Hazard Reduction Grant Program funds, $400,000 of Healthy Homes Funds and matching funds from
Cattaraugus County and Allegany County for $582,113.69. Program funds will be used for implementation of Lead
Hazard Reduction Grant and Healthy Homes Program activities from March 16, 2026 to March 16, 2030.
The activities proposed to be funded under this program is categorically
excluded from the national Environmental Policy Act requirements, but subject to compliance with some of the environmental laws and authorities listed at § 58.5 of 24 CFR Part 58. In accordance with § 58.15, a tiered
review process has been structured, whereby some environmental laws and authorities have been
reviewed and
student for the intended
target areas
listed above. Other applicable environmental laws and authorities will be complied with when individual projects are ripe for review. Specifically, the
target areas have been studied and compliance with the following laws and authorities have been established in this Tier 1 review: Coastal Barrier
Resources, Air Quality, Explosive and Flammable Hazards, Farmland Protection, Noise Abatement and Control, Sole Source Aquifers, Wild and Scenic Rivers and Environmental Justice. In the Tier 2 review, compliance with the following environmental laws and authorities will take place for proposed projects funded under the program listed above: Airport Hazards, Flood Insurance, Contamination and Toxic Substances, Rare, Threatened and Endangered
Species, Floodplain Management, Historic Preservation, and Wetlands Protection. Should individual aggregate projects exceed the threshold for categorical exclusion detailed at § 58.35(a), an Environmental Assessment will be completed and a separate Finding of No Significant Impact and Request for Release of Funds published. COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the
Cattaraugus County Health Department at the above
address. All
comments received by April 16, 2024 will be considered by the prior to
submission of a request for release of funds.
RELEASE OF FUNDS
The Cattaraugus County Health Department certifies to HUD that Robert W. Ring in his capacity as Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and
related laws and authorities, and
allows the
Cattaraugus County Health Department to use federal
program funds and
implement the
program.
OBJECTIONS TO RELEASE OF FUNDS
HUD will consider objections to its release of funds and the Cattaraugus County Health Department’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if the objections are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Cattaraugus County Health Department; (b) the Cattaraugus County Health Department has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the Cattaraugus County Health
Department or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58), and may be addressed to HUD as follows: Karen M.
