NOTICE IS HEREBY GIVEN that pursuant to a resolution of the Board of Fire Commissioners, a special election of the qualified voters of the Belmont Fire District will be held at the Belmont Fire Department firehouse at 80 Schuyler Street, Belmont, New York, on January 6, 2026 between the hours of 6:00 p.m. and 9:00 p.m. will be held to vote upon the following Bond Resolution:
SHALL THE RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE BELMONT FIRE DISTRICT, ALLEGANY COUNTY, NEW YORK (THE “DISTRICT”), DECLARING VACANT PROPERTY LOCATED ON HOOD ROAD IN THE TOWN OF AMITY SURPLUS AND NO LONGER NECESSARY FOR THE USE AND PURPOSES OF THE FIRE DISTRICT AND THE SAME BE SOLD UPON SUCH FURTHER TERMS OR CONDITIONS AS MAY BE IN THE BEST INTERESTS OF THE FIRE DISTRICT AS DETERMINED BY THE BOARD OF FIRE COMMISSIONERS, BE APPROVED?
WHEREAS, the Board of Fire Commissioners of the Belmont Fire District, Towns of Amity and Ward, Allegany County, New York (the “Fire District”) previously acquired certain vacant real property located on Hood Road in the Town of Amity (the "Property") which has been owned by the Belmont Fire District for meeting the future uses and purposes of the Fire District, and
WHEREAS, by determination of the Board of Fire Commissioners of the Fire District the Property is no longer necessary to retain such Property to achieve the objectives of the Fire District, and
WHEREAS, the Fire District has received a proposed purchase offer for the Property.
NOW, THEREFORE, BE IT;
RESOLVED, that the Board of Fire Commissioners of the Belmont Fire District, does hereby determine that the Property is no longer necessary for any of its uses or purposes and hereby declares the Property to be surplus, subject to mandatory referendum; and it is further
RESOLVED, that should the referendum be approved declaring the Property surplus, that it be that it be disposed of in a manner acceptable to the Board of Fire Commissioners as it may determine in its discretion; and it is further
RESOLVED, that this resolution is subject to a mandatory referendum as provided by Sections 176(23) and 179 of the Town Law, and such referendum shall appear in substantially the following form:
“SHALL THE RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE BELMONT FIRE DISTRICT, ALLEGANY COUNTY, NEW YORK (THE “FIRE DISTRICT”), DECLARING VACANT PROPERTY LOCATED ON HOOD ROAD IN THE TOWN OF AMITY SURPLUS AND NO LONGER NECESSARY FOR THE USE AND PURPOSES OF THE FIRE DISTRICT AND THE SAME BE SOLD UPON SUCH FURTHER TERMS OR CONDITIONS AS MAY BE IN THE BEST INTERESTS OF THE
FIRE DISTRICT AS DETERMINED BY THE BOARD OF FIRE COMMISSIONERS, BE
APPROVED?”
and it is further
RESOLVED, that pursuant to Sections 176(23) and 179 of the Town Law, this Resolution shall be subject to a mandatory referendum, to be held at a special election on January 6, 2026, in the manner prescribed by Sections 176(23) and 179 of the Town law of the State of New York. This Resolution shall not take effect until approved by the affirmative vote of a majority of the duly qualified voters of the Fire District voting on such proposition. As soon as reasonably possible after the date that this Resolution takes effect, the Secretary of the Fire District is hereby authorized and directed to cause a copy of such Resolution to be published in full in the Olean Times Herald, which is the designated official newspaper of the Fire District for such purposes, together with such other notices as may be required by such law.
PROPOSITION NO. 1
SHALL THE RESOLUTION OF THE BOARD OF FIRE COMMISSIONERS OF THE BELMONT FIRE DISTRICT, ALLEGANY COUNTY, NEW YORK (THE “FIRE DISTRICT”), DECLARING VACANT PROPERTY LOCATED ON HOOD ROAD IN THE TOWN OF AMITY SURPLUS AND NO LONGER NECESSARY FOR THE USE AND PURPOSES OF THE FIRE DISTRICT AND THE SAME BE SOLD UPON SUCH FURTHER TERMS OR CONDITIONS AS MAY BE IN THE BEST INTERESTS OF THE FIRE DISTRICT AS DETERMINED BY THE BOARD OF FIRE COMMISSIONERS, BE APPROVED?
Those who are qualified to vote on the aforesaid proposition are qualified voters who shall have resided in said Fire District for thirty days next preceding such election.
