ANNUAL

MEETING &

ELECTION OF THE FILLMORE CENTRAL SCHOOL

DISTRICT

NOTICE IS HEREBY GIVEN that a public hearing for the qualified voters of the

Fillmore Central School District of Allegany County in the State of New York (the “District”) will be held in the Board Room at Fillmore Central School located at 104 West Main Street, Fillmore, New York 14735 on Tuesday, May 12, 2026 at 5:30 pm for the presentation of the District’s proposed 2026-2027 Budget.

AND NOTICE IS ALSO GIVEN that the annual meeting and vote (the “Annual Vote”) of the Fillmore Central School District will be held on Tuesday, May 19, 2026 from 12:00 p.m. (noon) to 8 p.m. at the Fillmore Central School District building located at 104 West Main Street, Fillmore, New York, for the purposes of: (i) voting on the budget for the upcoming (2026-2027) fiscal year; (ii) for the election of one (1) member of the Board of Education of the District (the “Board); (iii) the purchase of district school buses; (iv) the funding of the Wide Awake Club Library; and (v) transacting other such business which may be authorized by law.

AND NOTICE IS ALSO GIVEN that the Board will have prepared and completed a detailed statement in writing of the amount of money which will be required during the 2026-27 fiscal year for school purposes, specifying the several

purposes and amount of each. Such statement shall be completed at least seven (7) days before the public hearing on the budget at which it is to be presented and copies thereof shall be prepared and made available, upon request, to residents within the district during the period of seven (7) days

before the public hearing, the fourteen (14) days immediately preceding the Annual Vote and the day of the Annual Vote, may be obtained by any resident at the District building during the hours of 8:00 a.m. to 4:00 p.m. excluding

Saturdays, Sundays and holidays.

AND NOTICE IS ALSO GIVEN that all candidates for the office of member of the Board shall be nominated by petition. Each petition shall be directed to the Clerk of the District, shall be signed by at least twenty-five (25) qualified voters of the District, shall state the residence of each signer, and shall state the name and residence of the candidate. Additionally, each petition must describe the

specific vacancy for which the candidate is nominated including at least the term of office and the name of the last incumbent. Each petition must be filed in the office of the Clerk of the

District between the hours of 9:00 a.m. and 5:00 p.m. not later than Monday, April 20, 2026. Petitions are available in the District Office located at 104 West Main Street, Fillmore, New York and are now being accepted. The following vacancy is to be filled:

Term of July 1, 2026 – June 30, 2031 (five years), name of last

incumbent – Faith Roeske.

AND NOTICE IS ALSO GIVEN that the qualified voters of the District shall be entitled to vote at said Annual Vote. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen (18) years of age or older, and (3) a resident within the District for a period of thirty (30) days next

preceding the Annual Vote. The District may require all

persons offering to vote at the Annual Vote to provide one form of proof of residency pursuant to Education Law § 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the District may also require all persons offering to vote to provide their signature, printed name and address.

AND NOTICE IS ALSO GIVEN that the voting business to be conducted at the Annual Vote will consist of voting on the following propositions, as well as any other matters as may be lawfully presented at the meeting:

PROPOSITION #1 – 2026-2027 Budget

Shall the following resolution be

adopted?

RESOLVED, that the budget for the Fillmore Central School District (the “District”) for the fiscal year commencing July 1, 2026 and ending June 30, 2027, as presented by the Board of Education of the District is hereby approved and adopted and the required funds therefore are hereby appropriated and the necessary real property taxes required shall be raised by a tax on the taxable property in the

District to be levied and collected as

required by law.

PROPOSITION #2 – Purchase of School Buses

Shall the following resolution be

adopted?

RESOLVED, that the Board of

Education of the Fillmore Central School District, New York (the

“District”), is hereby authorized to purchase two Blue Bird 65 passenger and one mini school buses (and related equipment) for use in the transportation program of the District at an estimated maximum cost of $490,645, and the District is authorized to expend or apply toward the purchase $200,000 from the District’s [Transportation] Capital Reserve Fund that was established in March of 2018, and the sum of $290,645, or so much thereof as may be

necessary, shall be raised by the levy of a tax upon the taxable property of the District and all other eligible legal fund sources; and in anticipation of such tax, bonds or other obligations (including, without limitation, obligations arising under leases, lease/

purchase contracts or installment purchase contracts) of the District are hereby authorized to be issued in an aggregate principal amount not to exceed $290,645 and shall be issued or entered into in accordance with applicable provisions of New York State law, and that New York State Transportation Aid funds expected to be received by the District are anticipated to offset a substantial part of such costs, and such funds, to the extent received, shall be applied to offset and reduce the amount of taxes herein authorized to be levied.

PROPOSITION #3 – Wide-Awake Club Library

Shall the following resolution be

adopted?

Resolved, the Board of Education of the Fillmore Central School is hereby authorized to levy taxes annually, separate and apart from the school district budget, in the amount of one

hundred seventeen thousand five hundred eighty dollars ($117,880) for the Wide-Awake Club Library to provide public library services and deliver such funds to the Wide-Awake Club Library’s board.

AND NOTICE IS ALSO GIVEN that pursuant to a rule adopted by the Board under §§2035 and 2008 of the Education Law, any referenda or propositions to amend the budget, or otherwise to be submitted for voting at the Annual Vote must comply with the Board’s adopted rules set forth in District Policy 1650. However, the Board will not entertain any petition to place before the voters any proposition the purpose of which is not within the powers of the voters to determine, or any proposition which fails to include a specific appropriation where the proposition requires the expenditure of monies. Printed copies of the policy are available at the office of the District Clerk at 104 West Main Street, Fillmore, New York.

AND NOTICE IS ALSO GIVEN that applications for absentee ballots may be applied for at the Office of the School District Clerk.

Applications for absentee ballots must be received by the School District Clerk by or prior to 5:00 p.m., (EDST) on May 12, 2026 if the ballot is to be mailed to the voter; or prior to 5:00 p.m. (EDST), May 18, 2026 if the ballot is to be issued personally by the Clerk at the District Clerk’s office. A list of all persons to whom absentee ballots shall have been issued will be available for

inspection in the

Office of the School District Clerk on each of the five (5) days prior to the day of the election (except Sunday), and such list shall also be posted at the voting place during the election, and any qualified voter may challenge the acceptance of the absentee voter's ballot of any person on such list, by making his challenge and the reasons therefor known to the Inspector of Election before the close of the polls. Absentee ballots must be received by the District Clerk not later than 5:00 p.m., on May 19, 2026, to be canvassed and counted.

AND NOTICE IS ALSO GIVEN that applications for

military voter

ballots may be

applied for at the

Office of the School District Clerk.

Applications for

military voter ballots must be received by the School District Clerk by or prior to 5:00 p.m., on April 23, 2026. Eligible military voters may designate preference for receiving their application: by mail, facsimile transmission or electronic mail. If no designation is indicated, the military ballot application will be transmitted by mail. Irrespective of the preferred method of transmission designated by a military voter, a military voter’s original military ballot application and military ballot must be returned by mail or in person to the office of the District Clerk at 104 West Main Street, Fillmore, New York and the ballot received no later than 5:00 p.m. on May 19, 2026, to be canvassed and counted.

AND NOTICE IS ALSO GIVEN that applications for an early mail ballot may be applied for at the Office of the School District Clerk. Applications for early mail ballots may be accepted beginning April 20, 2026 through May 13, 2026, to receive the ballot by regular mail and no later than May 18, 2026 to have the ballot delivered in person. A list of all persons to whom early mail ballots shall have been issued will be available for inspection in the Office of the School District Clerk on each of the five (5) days prior to the day of the election (except Sunday), and such list shall also be posted at the voting place during the election, and any qualified voter may challenge the acceptance of the early voter's ballot of any person on such list, by making his challenge and the reasons therefor known to the Inspector of Election before the close of the polls. Early mail ballots must be received by the District Clerk not later than 5:00 p.m. on May 19, 2026, to be

canvassed and counted.
