To: Shag Bark Land and Cattle Co. LLC and any and all unknown successors, heirs, or assigns.

TAKE NOTICE that Mark Accurso & Mary L. Accurso,

by and through an attorney, hereby demands that the following oil and gas lease be

cancelled and

released of

record pursuant to Section 15-304 of the New York

General

Obligations Law.

1. The oil and gas lease is dated January 17th, 2014, and was granted to Shag Bark Land and Cattle Co. LLC, whose address as set forth in the lease is 2851 West River Road, Olean, New York 14760. The lease was

recorded in the

Office of the

Cattaraugus County Clerk on January 21st, 2014, Instrument No. 210342-001

2. The leased premises are in the Town of Allegany, County of Cattaraugus, State of New York, and are more particularly described in the oil and gas lease. The property is generally located at 1181 Two Mile Road, Allegany, NY 14706.

3. The name or number of any wells located upon the premises are

Accurso 2- API# 31-009-28203,

Accurso 4- API# 31-009-28204, and

Accurso 7- API# 31-009-28205.

4. The above-referenced oil and gas lease terminated on February 1st, 2021, by reason of cessation of production/ operation.

Demand is hereby made that the

Lessee execute and

deliver a proper release and cancellation of said oil and gas lease. Unless the Lessee, within thirty (30) days after service of this Notice, executes and delivers such release, or files an affidavit pursuant to Section 15-304 of the New York General Obligations Law asserting that the lease remains in effect, the lease shall be deemed terminated and of no further force and effect and may be cancelled of record.
