LEGAL NOTICE NEW YORK STATE DEPARTMENT OF TRANSPORTATION, OFFICE OF RIGHT OF WAY, NOTICE OF APPROPRIATION OF PROPERTY. PROJECT: KARR VALLEY ROAD,C.R. 2, TOWN OF WEST ALMOND, COUNTY OF ALLEGANY, MAP NO. 2, PARCEL NO. 2. TAKE NOTICE THAT PURSUANT TO EMINENT DOMAIN PROCEDURE LAW, NOTICE is hereby given that there were filed in the office of the Department of Transportation on the 7th day of July, 2025, description and original tracing of a map, together with a certificate as to the accuracy thereof, of property which the Commissioner of Transportation deemed necessary to be acquired immediately for purposes connected with the project identified above that; there was filed in the office of the Allegany County Clerk on the 28th day of August, 2025, a copy of such description and map, whereupon the appropriation by the State of the property described in such description and map became complete and the title to such property vested in the People of the State of New York. Map of property in and to which an easement as herein above defined is deemed necessary by the Commissioner of Transportation to be acquired for and at the request of the County of Allegany by appropriation in the name of the People of the State of New York for purposes connected with the highway system of the State of New York pursuant to Section 30 of the Highway Law as made applicable by Section 10, Subdivision 34-A of the Highway Law and the Eminent Domain Procedure Law. There is excepted from this appropriation all the right, title and interest, if any, of the United States of America, in or to said property. PERMANENT EASEMENT FOR STREAM CHANNEL AND DRAINAGE. A permanent easement to be exercised in, on and over the property above delineated for the purpose of constructing, reconstructing and maintaining thereon a stream channel, drainage ditch and drainage structures, together with appurtenances in and to all that piece or parcel of property
designated as Parcel No. 2, as shown on the accompanying map and described as follows. Parcel 2: Beginning at a point on the existing northerly highway boundary of Karr Valley Road, said point being 31 +/- feet distant northerly, measured at right angles, from station 16+01 +/- of the hereinafter described 2024 Survey aseline; thence continuing along said highway boundary North 68 degrees 50 minutes 21 seconds East a distance of 157.98 feet to a point 106.82 feet distant northerly, measured at right angles,
from station 17+39.48 of said baseline; thence through the bed of road of Old County Highway No.2 North 46 degrees 03 minutes 43 seconds West a distance of 19.64 feet to a point in the bed of roadway of Old County Highway No.2, 118.47 feet distant northerly, measured at right angles, from station 17+23.66 of said baseline; thence South 66 degrees 18 minutes 12 seconds West a distance of 145.48 feet to a point in the bed of said road, said point being 42.92 feet distant northerly, measured at right angles, from station 15+99.33 of said baseline; thence South 00 degrees 09 minutes 15 seconds East a distance of 12 +/- feet to the Point of Beginning, containing 2221 square feet, more or less. The above mentioned Survey Baseline is a portion of the 2024 Survey Baseline completed by GdB Geospatial and described is as follows: Beginning at Station 10+00.00; thence, North 78 degrees 24 minutes 46 seconds East a distance of 483.97 feet to Station 14+83.97; thence South 82 degrees 24 minutes 48 seconds East
a distance of 498.15 feet to Station 19+82.12; thence South 84 degrees 17 minutes 17 seconds East a distance of 493.26 feet to Station 24+75.38. RESERVING, however, to the owner of any right, title, or interest in and to the property above delineated, and such owner’s successors or assigns, the right of access and the right of using said property and such use shall not be further limited or restricted under this easement beyond that which is necessary to effectuate its purposes for, and as established by, the construction or reconstruction and as so constructed or reconstructed, the maintenance, of the herein identified project.
